I have received your letter dated on April 5, 2007. I am very disappointed about it. I deeply suspect that you are an organization which protects “spirits of law”, the judicial department of the U.S., the right of petition according to the Constitution, and the right of access to courts.

I did not ask you to punish the bad attorney, Andrew Kim, with extreme penalty. I have asked you to punish Andrew Kim if he makes the case according to the rule or regulation of the State Bar of California.

As you stress through a media that there is a standard of punishment about the person who violates the ethics rule of attorney, I ask you to punish Andrew Kim if it is possible to punish him after you have investigated his bad behaviors.

The following is my re-response to your response.

1. At first, you asked “new information” to me. Since I have asked these kinds of petition to organizations like you for 20 years, they have responded very kindly to me about over 3 times.

The next step was to close my cases asking “new information or evidence” to me like you did. Your response is very similar. I am very disappointed about it because I think there are some problems which seem to order to me to manipulate evidence or find additional evidences in the heaven. There is no more evidence to me. Although I have no more additional evidences left, you are asking additional evidences to me. I think this means that you do not want to punish Andrew Kim, and you are seeking or taking advantage of complainant’s weaknesses. How could it be more additional evidences in this case?

2.The person who passed the State Bar of California, Andrew Kim

a. Andrew Kim, an attorney, submitted a manipulated application of acceptance of an case and admitted that he received a case which a client did not asked to him to take.

b. Andrew Kim, an attorney, cheated a judge and alleged plaintiff which is not a real plaintiff.

c. A plaintiff, Simon Bae, warned Andrew Kim several times “not to intervene in my case at all,” sent “a notice of firing attorney,” and telephoned him, but Andrew Kim, a bad attorney, did not receive the plaintiff’s agreement, manipulated documents, helped the opposite defendants, made some files for the defendants, and submitted it to a judge. Andrew Kim made cheated documents for the plaintiff to lose, submitted cheated documents to a judge, and finally made a plaintiff lose a case. Andrew Kim especially met the defendants without letting the plaintiff know it, and said to them that the defendants should “help” Andrew Kim because he wanted to join as a candidate of president of the Korean American Federation in Los Angeles.

Although Andrew Kim definitely has violated the ethics rule of the State Bar of California, you only “analyzed” the materials submitted by a complainant without investigating Andrew Kim. And although you have received enough substantial evidences from me, and you do not have to receive additional evidences from me, you closed my complaints. According to this fact, I deeply suspect you and your identity.

Analyzing or investigating like this way in itself has some problems. When I repeatedly analyze your response letters, I feel some sense that you do not have any desire or intention to investigate this case from the starts.

From now on, do not send your response letter which is repeated over 3 times to me already. Do not play with rights of petition using that way. Our citizens can not respect you who can not punish the bad attorney who is a cheated criminal. On the contrary, I can suspect that you are protecting those crimes.

Finally, this bad attorney, Andrew Kim, has cheated 4 more cases, and has violated more than that of ethics rule of the State Bar of California. With this case, you have decided that it is not necessary to investigate this case any more. That decision is abusing your authority, and you deserve to be criticized harshly.

If you do not investigate this case and do not punish Andrew Kim, I do not trust your organization. I am surprised and shocked because you have evaded your responsibility which I might misunderstand. I have deeply questioned to myself that for what we are conducting Iraq War.

You who are investigating this case did not call me at least, a complaint, and did not investigate basic things about grounds or background. And what does this mean? This is a big mystery. You are not lawyers any more who “protect laws” expressed in the U.S. Constitution. “Do and handle” this case as you want! I will remember you permanently.

나는, 귀하들이 보내 준 4월 5일 자 회신을 받았다. 나는 실망이다. 당신들이 과연 미국의 사법부 내지는 '법의 정신'을 지키며, 헌법에 보장된 국민의 청원권, 그리고 재판 청구권을 수호해 주는 조직인지 의심하지 않을 수 없다.

내가, 당신들에게 김 기현 이라는 악질(악덕 수준이 아니다)변호사를 사형에 처해 달라고 주문한 것이 아니라, 켈리포니아주 변호사협회가 규정한 내규에 따라 징계 해당사유가 되면 처벌하라는 것이다.

당신들은 언론을 통해 변호사 윤리규정 위반자에 대한 처벌기준이 있다고 강조했듯, 나는 김 기현 변호사라는 악질의 행위들에 대해 심사한 후, 처벌이 가능한면 처벌하라는 것이다.

다음은, 귀하들의 회신에 대한 재답신 이다.

1. 먼저, 귀하는 나에게 "새로운 정보"를 요구했다. 나는 지난 20년 전 부터 귀하 같은 기관에 이 같은 종류의 청원을 하면, 그들은 아주 친절하게 회신을 약 3차례 이상을 했다.

그 다음은, 바로 귀하들 처럼 사건종결을 하면서, '새로운 정보-증거'를 요구했다. 오늘도 그와 같은 수준이다. 패턴이다. 실망이다. 왜냐하면, 그 이상의 증거가 없는 데, 하늘 나라에 가서 추가 증거물을 찾아오거나, 마치 증거조작을 하라는 식의 주문에 문제가 있다는 것이다. 추가 증거가 없을 수 밖에 없는데도, 당신들이 추가 증거를 달라는 것은 고발인의 약점을 잡아 처벌을 하지 않으려는 수작으로 판단한다. 본건에서 이상의 추가 증거가 어디 있을 수 있나 ?

2. 켈리포니아주 변호사 시험에 합격한 자가,

a.  김 기현 변호사가, 사건 의뢰를 하지 않은 사람의 케이스를 수임했다면서 허위 조작 사건수임 신청서를 판사에게 제출했고,

b.  김 기현 변호사가 원고인도 아닌 원고인을 "원고인"이라면서 판사를 속인 행위를 했으며,

c. 원고인이 문제의 변호사에게 "나의 케이스에 일체 개입하지 말라"고 수 차례 경고 했고, [변호사 해고통지서]까지 우송했고, 전화까지 했는데도, 문제의 악질 변호사가 원고인에게 동의를 받지 않고 서류를 조작하거나 피고인과 짜고 피고인을 유리하게 하는 파일을 만들어 판사에게 제출했고, 또 원고인이 패소할 수 있도록 서류를 조작하여 판사에게 제츨, 마침내 원고인이 패소하도록 작용했다. 김 기현은 특히 원고인 몰래 피고인들을 만나 자신을 "도와 달라"고 까지 했다(자신이 한인회장 출마를 한다면서)

이러한 악질 변호사의 관련 윤리규정 위반사실이 명백 함에도 불구하고, 귀하들이 김 기현을 조사하지 않고 고발인의 제출 자료를 '분석'만 했으며, 추가 증거가 필요치 않을 정도의 결정적인 증거물들을 접수하고도, 고발인의 조사도 없이 조사를 종결했다는 것은, 당신들의 정체를 의심한다는 것이다.

당신들이 이러한 식으로 조사, 혹은 분석을 한다는 자체가, 의혹이 있다는 것이다. 귀하들의 회신을 거듭 분석하면(내가) 당신들이 이 케이스를 처음 부터 조사할 의사가 없다는 흔적들이 노출되어 있다.

이제, 당신들도 나에게 3회 이상 반복, 회신했던 내용들을 보내지 말라. 그런 수법으로 국민의 청원권 등을 우롱하지 말라. 위와 같은 사기범 변호사를 처벌 못하는 귀하들은, 우리 국민이 존경할 수 없다. 당신들이 도리어 범죄를 비호하는 세력으로 판단할 수 있다.

끝으로, 당신들이 악질 변호사가 4건 이상의 부정한 행위를 하였고, 더 나아 가  켈리포니아주 변호사 윤리규정 이상의 범죄를 했음에도 조사가치가 없다고 결정했다는 것은 중대한 직권남용 이다. 당신들은 그 이상의 비판을 면치 못한다.

나는, 당신들이 본건에 대해 조사하지 않고 징계하지 않으면, 나는 귀하의 조직에 대해 불신한다. 나는 오늘 당신들의 충분히 오해받을 수 있는 책임회피 행동들을 다시 확인하였기 때문에, 충격을 받았다. 우리가 왜 이라크 전쟁을 하는가에 대해 회의를 느꼈다.

당신들이, 이 같은 사건을 심사한다는 당신들이, 최소한 고발인이라는 나를 불러 고발 배경에 대한 기초 조사도 하지 않았다는 것은 무엇을 의미하는가 ? 그것이 최대의 미스테리 다. 당신들은 헌법이 명시한 '법을 수호'하는 법률가들이 아니다. 당신들은 본건에 대해 '처리'하고 싶은 대로 하라 ! 나는, 당신들을 영원히 기억할 것이다.

“감사 및 검토부서(오딧 앤 리뷰)”는 2007년 3월 19일자의 당신 서신을 받았습니다. 그 서신에는, 당신의 컴플레인트(조사요청)를 마감하려는 “주 변호사 협회” 변호사의 결정을 재고해 달라는 요청이었습니다. 현재 우리의 상당량 분량의 사건들과, 제출한 파일에 있는 자료들, 각 사건을 주의깊게 검토하려는 필요성 등 때문에, 당신의 문제가 언제 할당될 지 그 날짜를 추측할 수가 없다. 우리는 당신의 인내에 대해 고맙다.

우리는 당신에게 다음 내용을 확신한다. 즉, 일단 우리 변호사가 당신의 파일을 검토한 후에는, 우리의 결정을 당신에게 조언하는 하나의 편지를 당신은 받게 될 것이다. 만약 그 문제가, 다시 열려야 한다고 우리가 결정하게 된다면, 당신은 통지 받게 될 것이고, 그 문제는, 추가로 적절한 조치를 위해, 재할당될 것이다. 만약, 그 문제가 그대로 마감되어야 한다고 우리가 결정하게 된다면, “캘리포니아 대법원”에 청원할 당신의 권리를 조언 받을 것이다. 만약 당신이 우리로부터 소식을 듣지 못한다면, 그 문제가 아직 할당되지 않았거나, 검토되지 않았기 때문이다.

만약, 당신이 이전에 우리에게 제공했던 것 보다 다른, 새로운 정보를 우리가 고려하기를, 당신이 원한다면, 우리에게,
